Website Terms and Conditions

These Terms & Conditions (“Terms”) govern the use of services provided by HOM – High On Movement (“HOM”, “we”, “our”, or “us”). By purchasing a membership, booking a class, or using our facilities, you agree to be bound by these Terms.

Effective Date: October 1st, 2025


1. Services

HOM provides boutique fitness services, including but not limited to:

Group resistance strength training classes.

Recovery facilities, including infrared sauna and red light therapy.

Functional nutrition and juice bar.


2. Memberships & Packs

Memberships and packs are personal, non-transferable, and non-refundable unless required by law.

Expiry dates are stated at the time of purchase and cannot be extended unless explicitly authorised.

HOM reserves the right to adjust membership pricing and packages.


3. Booking & Cancellations

Classes must be booked in advance through our official booking system.

Cancellations or reschedules must be made at least 12 hours before the scheduled class.

If you cancel less than 12 hours before class or do not attend, the class will be deducted from your membership or pack.

HOM reserves the right to cancel or reschedule classes. In such cases, members will not be charged.


4. Studio Rules

A 3-minute grace period applies after class begins. First-time members must arrive 10 minutes early for onboarding. Beyond the grace period, entry is not permitted.

Appropriate athletic attire and non-slip grip socks are required for all sessions.

Members are responsible for their belongings. HOM is not liable for lost or stolen items.

Use of recovery facilities must follow the guidelines provided by the team.

Members must strictly follow instructions provided by HOM personnel.

Members must use the services and property of HOM in an appropriate manner, assuming responsibility for any damage caused to equipment, facilities, staff, or third parties.

Members must return all accessories and equipment to their designated locations after use.


5. Code of Conduct

To maintain a safe and respectful environment, the following behaviours are strictly prohibited:

Practising any commercial activity within HOM’s premises without prior written authorisation.

Misusing equipment, accessories, or facilities.

Failing to return used equipment to its designated location.

Creating a disturbing, disruptive, or unsafe environment.

Physically or verbally assaulting or harassing other members or staff.

Wearing clothing or footwear inappropriate for physical activities.

Bringing pets or animals into HOM, except certified service animals.

Entering the premises with unauthorised individuals.

Filming or photographing within HOM’s premises without prior consent from management.

Distributing promotional materials or displaying merchandise of any kind in common areas.

Violation of this Code of Conduct may result in suspension or termination of membership without refund.


6. Health & Safety

By participating in HOM activities, you confirm that you are in suitable health and physical condition.

If you have any medical conditions, injuries, or concerns, you must inform your instructor before class.

Participation is at your own risk. HOM accepts no liability for injuries unless caused by gross negligence.

HOM may require medical examinations as a condition of access to its facilities. If the medical report results in the inability to practise physical activities, HOM may prevent the member’s access to its facilities.

HOM reserves the right to deny access to classes or facilities if it reasonably believes a member’s health condition poses a risk to themselves or others.


7. Payments

All payments must be made via approved methods, including credit card, debit card, or direct payment through our booking platform.

Prices include applicable VAT unless otherwise stated.

Payment terms and billing schedules are outlined at the time of purchase and in your Membership Agreement.

Failed or outstanding payments may result in suspension of membership or access to services until resolved.


8. Membership Terms

Memberships and packs are personal, non-transferable, and may be subject to automatic renewal.

General conditions relating to cancellation, renewal, freeze options, and other membership-specific policies are set out in your individual Membership Agreement.

By purchasing or activating a membership, you acknowledge and agree to the Membership Agreement in force at the time of purchase.


9. Liability & Waiver

By joining HOM, you acknowledge that physical exercise and use of recovery facilities carry inherent risks. HOM, its staff, and instructors are not liable for any injury, loss, or damage incurred while using our services, except in cases of proven negligence.

Members acknowledge and agree that HOM is not responsible for personal property brought into the premises.


10. Personal Data

We process your personal data in accordance with our Privacy Policy, available on our website.


11. Changes to Terms

We may update these Terms from time to time. The latest version will always be published on our website. Continued use of our services constitutes acceptance of updated Terms.


12. Governing Law

These Terms shall be governed by and construed in accordance with Portuguese law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
