Memberships Terms and Conditions
1. Parties
This Membership Agreement is entered into between HOM – High On Movement, Unipessoal, Lda., company number 518839630, headquartered in Portugal, hereinafter referred to as “HOM”, and the individual identified at the time of subscription via HOM’s official booking platform, hereinafter referred to as the “Member”.
2. Purpose of the Agreement
This Agreement governs the terms and conditions under which the Member may access and use the services provided by HOM, including but not limited to training sessions, use of facilities, and related services, in accordance with the membership plan selected by the Member.
3. Membership Plan
The Member subscribes to a specific plan (e.g. monthly session packs, unlimited plans, recovery add-ons), the commercial conditions of which — including price, frequency, minimum duration and included benefits — are those presented and accepted at the time of subscription via HOM’s official booking platform.
Memberships are personal and non-transferable, and may only be used by the registered Member.
4. Duration and Renewal
This Agreement becomes effective on the activation date of the membership and remains valid for the minimum period associated with the selected plan.
Unless expressly stated otherwise at the time of subscription, memberships automatically renew for successive periods equal to the initially contracted term.
If the member terminates the membership at their own initiative, a cancellation fee equivalent to 50% of the remaining contract value will apply.
All memberships are non-refundable, except where reimbursement is required by applicable law.
5. Payments
Membership fees are charged on a recurring basis, according to the billing frequency defined in the selected plan. All prices include applicable VAT, unless expressly stated otherwise. The first payment is charged at the time of purchase. Subsequent payments are billed monthly from the date of the Member’s first booked session.
Failure to process payment may result in immediate suspension of access to services until the outstanding amount is settled.
The existence of any outstanding payments for more than 30 (thirty) days entitles HOM to terminate the contract, by written notice, consequently cancelling the membership, without prejudice to the settlement of amounts due up to the end of the minimum period stipulated in the membership plan.
6. Cancellation
The Member may cancel the membership by providing written notice to HOM’s official email address, with a minimum notice period of 30 (thirty) days prior to the renewal date of the plan.
If notice is not provided within this period, the automatic renewal will remain in effect.
Early termination of the membership commitment before the end of the contracted period is subject to a cancellation fee equivalent to 50% of the remaining contract value.
7. Membership Suspension (Freeze)
HOM offers limited membership suspension flexibility under the following conditions: up to two (2) pauses per contract year, each with a maximum duration of 15 consecutive days; or one (1) pause per contract year, with a maximum duration of 30 consecutive days.
All suspension requests must be submitted in writing not less than fifteen days in advance and are subject to confirmation by HOM. During the suspension period, access to services is suspended and payments will be made in proportion to the periods in which the contract was not suspended.
8. Rules of Use
The Member confirms having read, understood and accepted HOM’s Terms & Conditions, which form an integral part of this contractual relationship.
9. Health, Risk and Liability
The Member declares to be in suitable physical condition to engage in physical exercise and recovery sessions, and accepts full responsibility for informing HOM of any relevant medical condition.
Participation is voluntary and involves inherent risks. HOM shall not be held liable for any injury or damage, except in cases of proven gross negligence.
The Member assures that they have no contraindications for the practice of physical activity or the use of recovery facilities, including infrared sauna and red light therapy, and undertakes to maintain appropriate insurance for the activities practised.
HOM is not responsible for any physical, material or moral damages that the Member may suffer as a result of the practice of physical activities or use of recovery facilities on its premises, including but not limited to bodily injury, illness or death.
10. Packs
Scope
Training and recovery packs grant access to a fixed number of sessions and do not constitute a recurring membership. All packs are personal and non-transferable and may only be used by the individual who purchased them.
Validity
Each pack has a defined validity period, clearly stated at the time of purchase. Unused sessions expire automatically at the end of the validity period and cannot be extended, transferred, or refunded.
Bookings, Cancellations & No-Shows
Sessions must be booked in advance via HOM’s official booking system and are subject to availability. Late cancellations or no-shows will result in the session being deducted from the pack.
Freeze & Conversions
Packs do not include freeze options and cannot be paused, suspended, or converted into memberships.
Refunds
All packs are non-refundable, except where reimbursement is required by applicable law.
11. Personal Data
Personal data is processed in accordance with HOM’s Privacy Policy and Cookies Policy.
12. Governing Law and Jurisdiction
This Agreement is governed by Portuguese law. Any disputes arising herefrom shall be subject to the exclusive jurisdiction of the courts of Lisboa Oeste, Portugal.
By subscribing, the Member confirms full acceptance of this Membership Agreement.
